The order directs a list of jurisdictions that largely remove cash bail for serious offenses and requires agencies to find federal funds that could be withheld, subject to law.
The Attorney General must identify States and local jurisdictions that largely remove cash bail for serious offenses, then update the list as needed.
Federal agencies must find grants and contracts going to listed jurisdictions that could be suspended or ended, but any action must follow existing law and available funding.
The Attorney General must submit a list of covered States and local jurisdictions to the President. The list covers jurisdictions that substantially eliminate cash bail as a possible pretrial release condition for offenses involving serious threats, including violent, sexual, or indecent acts, burglary, looting, or vandalism. The list is based on the Attorney General’s opinion. The Attorney General must update the list as needed. The first list is due within 30 days after August 25, 2025, and later updates have no stated deadline.
Federal department and agency heads must review funding provided to jurisdictions on the Attorney General’s list. The review covers federal funds, including grants and contracts, currently going to listed cashless-bail jurisdictions. Agencies must coordinate with the Office of Management and Budget. Funds may be suspended or terminated only as appropriate and consistent with applicable law. Implementation is subject to available appropriations. The order does not itself suspend or terminate any funding or create an enforceable right or benefit. The order gives no separate deadline for completing the funding review or taking later action.
