Until December 16, 2025, the Justice Department must not enforce the federal app law or penalize covered entities for specified earlier conduct.
The Justice Department must not enforce the federal app law or impose penalties through December 16, 2025, and must protect covered providers from liability for conduct during the delay and earlier covered conduct.
The President directs the Justice Department not to enforce the federal app law or impose penalties against covered entities. This covers any entity and any foreign-adversary-controlled application covered by the law, including distributing, maintaining, updating, or enabling those activities. The Attorney General must issue written guidance and send each provider a letter stating that covered conduct caused no violation or liability during the specified periods. The Attorney General must use available authority to defend the Executive Branch's stated exclusive power to enforce the law. The order must be carried out under applicable law and only as funding allows. It creates no enforceable right or benefit. The enforcement delay runs through December 16, 2025. The Justice Department also may not later enforce the law or impose penalties for conduct during the delay or conduct before September 16, 2025, including conduct from January 19, 2025, onward.
