The Attorney General and FTC chairman must each establish a Food Supply Chain Security Task Force. The task forces must investigate possible anti-competitive behavior and foreign control in U.S. food supply chains. The investigations cover food-related industries within the Justice Department’s and FTC’s existing areas of expertise. The agencies must act within their legal authority. If the Justice Department task force finds evidence of criminal collusion, the Attorney General must begin appropriate criminal proceedings, including possible grand jury investigations. If either task force finds anti-competitive behavior, the agencies must take appropriate steps to address it, including enforcement actions or proposed regulatory approaches. Implementation depends on available funding.
The task forces must jointly brief specified congressional leaders and committee chairs about their progress. Briefings go to the House Speaker, Senate majority leader, and chairs of congressional committees with jurisdiction. Briefings may include recommended congressional action when relevant. They may not include information about ongoing investigations, prosecutions, regulatory actions, litigation, or nonpublic industry information. The briefings must follow applicable law and depend on available funding. The first briefing is due within 180 days after December 6, 2025. The second is due within 365 days after December 6, 2025.
