For applications to build industrial facilities filed on or after July 1, 2027, eligible local governments could seek early payments for needed projects or equipment if the state council approves.
For covered applications filed on or after July 1, 2027, early payments could cover no more than half the approved total. Later payments would be reduced by the early amount.
A state council would review local requests for early construction impact payments. A city, town, or county must qualify for payments to address industrial construction impacts. The request must name specific projects or equipment needed to address construction impacts left unresolved. The council must find an early payment necessary for those items, and the money may be spent only on the items named in the request. This would apply to impact payments tied to industrial facility permit applications filed on or after July 1, 2027.
The state would cap early payments and subtract them from later payments. These limits apply to each eligible city, town, or county that receives an early payment. An early payment may not exceed half of the total impact payment authorized for that city, town, or county. The state must reduce later impact payments by the amount paid early. The council must calculate the local government's total impact payment before any early payment is issued.
