Facilities already exempt from lifeguard and first aid staffing rules could keep those exemptions during restricted outside swim lessons led on-site by a certified lifeguard.
Pools could keep lifeguard and first aid staffing exemptions for outside swim lessons held separately from regular swimming, with limited enrollment and advance signup. Lessons must be closed to the public and taught on-site by a certified lifeguard, while keeping pools mainly available to regular users.
Eligible facilities could host outside swim lessons without losing their lifeguard and first aid staffing exemptions. Covered facilities include registered retirement communities, state-authorized continuing care communities, and licensed assisted living or similar residences. Lessons must be closed to the public, require advance signup, and limit enrollment. Lessons must run separately from general swimming, and facilities must remain mainly available to residents or other authorized users. The outside provider’s employee must teach on-site and hold lifeguard certification recognized by the state health department. State and local health officials would retain their enforcement powers. The change would take effect immediately upon enactment.
