Starting in 2028, people eligible for Medicare could enroll yearly in supplemental coverage without health-based denial or price discrimination.
Starting January 1, 2028, insurers would offer yearly enrollment in Medicare supplemental policies without rejecting applicants or changing prices because of their health or medical history.
Health and Human Services would explain the proposed enrollment rules in the “Medicare & You” and “Welcome to Medicare” notices.
Each insurer would have to offer a general enrollment period every year and accept eligible applicants without health-based denial or pricing discrimination. Anyone eligible for Medicare benefits could enroll in any Medicare supplemental policy offered by the insurer. Insurers could not deny or limit coverage, delay when it takes effect, or vary prices because of an applicant’s health, claims, medical care, or medical condition. These protections would apply only to applications made during the yearly enrollment period. Beginning January 1, 2028, each yearly window would match Medicare’s annual coordinated plan-choice period.
The Secretary of Health and Human Services would add information about the enrollment rules to two Medicare notices. The update would cover the notices commonly called “Medicare & You” and “Welcome to Medicare.” The Secretary would have to update the notices within 30 days after the proposal becomes law.
