New Jersey would let community solar projects on certain sites include related parcels, without limits based on those parcels’ share of the project.
Community solar projects on landfills, polluted or potentially polluted sites, and mining sites could include connected or separate related land. Regulators could not limit that land’s share of the project’s area or capacity.
State utility regulators would allow these community solar projects to include related land. This covers projects on landfills, brownfields—previously used land that may be polluted—contaminated sites, and mining sites. Related parcels may touch the site or be separate. The added land must be developed as part of the same project. The Board of Public Utilities could not limit the related land’s share of the project’s total area or power capacity. The changes would take effect immediately if enacted.
