People affected by zoning board decisions may appeal to circuit court, but the data center law may set additional rules for review.
Zoning ordinances would be subject to the data center local decision protection act. This applies to zoning ordinances under Michigan's zoning enabling act. The amendment takes effect only if HB 6426 is enacted into law. The amendment would take effect 90 days after enactment, and only if HB 6426 is enacted.
People challenging certain zoning board decisions could appeal in circuit court, subject to the data center law. A person affected by a zoning board of appeals decision may appeal to the circuit court for the county where the property is located. The court reviews whether the decision followed the law and proper procedure, rests on sufficient evidence, and reasonably used the board's discretion. The data center law may impose additional rules. An appeal must be filed by whichever comes first: 30 days after the board issues its signed written decision, or 21 days after it approves the minutes.
No hearings or votes scheduled.
