Starting in 2027, states would electronically verify Medicaid rides and behavior therapy, unless they already require a system and continue requiring it.
States would electronically verify Medicaid rides and applied behavior analysis services provided on or after January 1, 2027. States already requiring a system to verify these services would be exempt while they keep requiring it.
If the Secretary finds a state out of compliance, the state would have to submit a plan explaining how it will meet the electronic verification requirement.
States would have to use an electronic system to verify Medicaid non-emergency transportation and applied behavior analysis services. The requirement covers services provided under a state Medicaid plan or a waiver of that plan. A state already requiring an electronic system for these services when this subsection is enacted would be exempt while it continues requiring that system. The requirement applies to covered services furnished on or after January 1, 2027.
The Secretary would notify a state found out of compliance, and the state would have to submit a plan to correct the problem. This applies when the Secretary determines that a state is not complying with the electronic verification requirement. The plan must explain how the state will meet the electronic verification requirement. The state must submit its plan within 90 days after receiving notice. The plan must show how the state will comply by one year after receiving that notice.
