After two legislative approvals, Pennsylvania voters would decide whether to drop constitutional requirements for equal tax treatment within each category and taxing area.
With approval from lawmakers and voters, the amendment would drop constitutional rules requiring equal tax treatment within each category and taxing area, and requiring taxes to follow general laws.
The proposed amendment would take Article VIII, Section 1 out of Pennsylvania’s Constitution. The targeted section covers all taxes. It requires equal treatment within the same tax category and taxing area, and requires taxes to be imposed and collected under laws that apply generally. The amendment would need two passages by the General Assembly and approval from voters. The Secretary of the Commonwealth would follow the Constitution’s public notice requirements immediately after each legislative passage. After the second legislative passage, the Secretary of the Commonwealth would put the amendment before voters at the first general or municipal election that meets the Constitution’s requirements.
