A private school would send a transferring student’s discipline records to the public school district that asks in writing, without needing written consent.
When a student moves from a qualifying New Jersey private school to a public school, the private school would send discipline records within 14 calendar days of the district’s written request.
The former school’s chief administrator would send discipline records to the receiving public school district. This covers students moving from New Jersey K–12 nonpublic schools that meet attendance requirements and comply with federal civil rights law. The district must ask in writing. The school must also tell the district in writing if it has covered court or law enforcement information about charges against the student. The school must notify the parent or adult student in writing of the transfer, but it need not get their written consent. If the records do not arrive, the district must use every available means to get them. The school would have 14 calendar days after the district’s written request to send the records and report any covered information. The act would take effect immediately if enacted.
