If two related bills also become law, facilities would have to apply criminal-history rules to people seeking covered work with direct patient access.
Facilities would be barred from hiring, contracting with, or granting clinical privileges to covered workers with certain convictions or substantiated findings. The proposal depends on approval of two other bills.
The proposed text bars facilities from hiring, contracting with, or granting clinical privileges to some people with listed convictions or substantiated findings. The rules cover people who regularly have direct access to patients or residents, or provide them direct services, at psychiatric facilities and certain other facilities. The listed offenses have different time limits; some relevant crimes are exceptions to those limits. This amendatory act would take effect only if House Bills 6401 and 6402 are enacted into law. If all three bills become law, this amendatory act would take effect 90 days after enactment.
No hearings or votes scheduled.
