The bill would revise definitions used in wheelchair sales and leasing law, including tests for repeated repairs or time out of service, if HB 6347 also becomes law.
The bill text defines wheelchair warranty and repair terms, including when a serious covered problem may count as unrepaired after repeated attempts or long time out of service.
The bill would revise definitions used in Michigan's wheelchair sales and leasing law. A consumer includes a wheelchair buyer, certain people who receive a wheelchair before its warranty expires, someone who may enforce the warranty, or someone leasing under a written lease. A nonconformity is a serious problem covered by the warranty, but excludes problems caused by consumer abuse, neglect, or unauthorized changes. This amendatory act would take effect only if HB 6347 is enacted into law. For a new wheelchair, the repair tests apply during its warranty or within one year after first delivery, whichever comes sooner.
