Certain residential facilities could let outside providers give scheduled swimming lessons while keeping their state staffing exemption, if a certified lifeguard is present.
Certain residential facilities could host outside swimming lessons and keep their state staffing exemption, if classes are limited, scheduled separately, and led by a certified lifeguard.
A specially exempt facility may keep its exemption while a third-party provider holds swimming lessons, classes, or instruction there. This applies to specially exempt facilities, including retirement communities, continuing care retirement communities, assisted living facilities, and similar residential facilities licensed by the state. Lessons cannot be open to the general public, and participants must register in advance and attend at scheduled times. The facility must limit class size and schedule lessons separately from general use by residents or other authorized users. A provider's employee must be present and hold lifeguard certification from an organization recognized by the Department of Health. State and local health authorities keep their enforcement powers. The act would take effect immediately if enacted.
