For development applications filed after the measure takes effect, large electric facilities would need to show they applied for service and paid related utility fees before zoning approval.
Large facilities using at least 10 megawatts would need to show they applied for electric service and paid related utility fees before receiving zoning approval.
Applicants for large electric facilities would have to give local zoning officials proof that they applied for electric service and paid the related utility fees and costs. A large electric facility means a facility, campus, or connected group of facilities with peak demand of at least 10 megawatts, whether commonly or separately owned or rented. A municipality could allow the facility by right, through a conditional use, or by special exception only if the applicant provides the required proof. The proof must show an application for electric service was filed with the proposed utility or other provider and that all fees and costs tied to that application were paid. The condition would apply to development applications filed on or after the act's effective date, and the act would take effect 30 days after enactment.
