People receiving abortions would not be liable for offenses related to a violation of this disposal ban involving their own abortion.
Abortion providers would be barred from causing abortion waste to be placed into public water systems. The ban would cover fetal remains and all related medical waste in government-owned or government-controlled water systems, including connected drains and pipes. Procedures intended to produce a live birth and preserve the child's life and health, or to remove an already dead fetus, fall outside the abortion definition. State and local bans on this disposal would remain in place.
People receiving abortions would be shielded from liability for offenses related to the disposal violation involving their abortion. A person receiving an abortion would also be excluded from the definition of provider for that abortion. The protection would apply despite other laws, but only to offenses related to this disposal ban.
