Rail shippers could get quicker Board decisions on service disputes and, after a finding against a carrier, delivery standards matched to their needs.
The Board would have up to 180 days to decide a rail service complaint and up to 45 days to decide a request for service terms.
When reviewing whether a carrier provided reasonable service, the Board would consider local schedules, staffing, equipment, the shipper's needs, and conditions the carrier sets.
If the Board finds a carrier failed to provide service on reasonable request, it would set reasonable delivery times or other standards suited to the shipper's needs.
The Surface Transportation Board would review rail service complaints and requests more quickly. The deadlines apply to proceedings about alleged failures to provide reasonable rail service and requests for service terms. The deadlines run from the start of each proceeding.
The Board would consider specified service factors when deciding if a rail carrier met its obligations. The factors concern a person's request for rail transportation or service, including the carrier's handling of equipment owned by others. Factors include service schedules, staffing, equipment and infrastructure, the shipper's needs and past experience, and service conditions imposed by the carrier.
The Board would set reasonable delivery or other service standards after finding that a carrier failed to provide service on reasonable request. This applies when the Board finds that a rail carrier failed to provide transportation or service on reasonable request. The standards must fit the requesting person's needs for efficient and reliable transport and delivery of property.
