Rutland could grant one off-premises alcohol sales license to the store at 26 Pommogusett Road. The license could not move and would require proof that state payments are current.
If the license ends or is no longer used, Rutland could give it to another applicant at the same store for up to three years after its return; otherwise, it would dissolve.
Rutland's licensing authority may grant one license to sell all alcoholic beverages for drinking off the premises. The license would go to Varahi Foods Inc., doing business as Rutland Market Place, at 26 Pommogusett Road. The license would follow all rules in chapter 138 of the General Laws except section 17. The license could not be moved to another location. A new applicant could receive the license at the same location only after providing state letters showing that required taxes, fees, and contributions have been paid. The license must be issued within one year after this act takes effect. If issued during that period, it could later be transferred to a new applicant under the stated rules.
Rutland's licensing authority may reissue the license to a new applicant at the same location after the license ends or is no longer used. This applies if the license is terminated, not renewed, canceled, revoked, or no longer in use. The license must be physically returned to the licensing authority with its legal rights, privileges, and restrictions. The reissued license would remain subject to the act's terms and conditions. If the authority does not reissue it within three years after its return, the license would dissolve. The authority may reissue the returned license during the three years after its return.
