Health care providers would be barred from performing, arranging, or referring for specified gender-transition medical interventions for minors. The rule would cover people under 18 and include certain sterilizing surgeries, mastectomies, puberty-blocking drugs, high-dose sex hormones, and removal of healthy tissue. The restriction would apply when the purpose is to change a minor’s body to match a sex different from the minor’s biological sex. Exceptions would cover good-faith care for certain medically verifiable disorders of sex development, treatment of infections or other problems caused or worsened by an earlier procedure, and procedures needed to prevent imminent death or loss of a major bodily function. The restriction would begin on the first day of the seventh month beginning after publication, if the measure took effect.
Professional licensing boards would investigate alleged violations, hold a hearing after finding probable cause, and revoke the responsible provider’s license or certificate after finding a violation. The rules would apply to covered medical, nursing, physician, and other licensed health care professionals identified in the bill. The board would have to investigate the allegation and find probable cause before holding a hearing. After revocation under these provisions, the affected credential could not be restored or reinstated under the cited restoration rules. These investigations, hearings, and penalties would begin when the underlying restriction took effect, on the first day of the seventh month beginning after publication.
