Wisconsin's LLC fee waiver covers qualifying student entrepreneurs
Wisconsin law waives the $130 LLC filing fee when every member or organizer is an eligible student entrepreneur, including qualifying high school and homeschooled students.
1
What it does
Student entrepreneurs who are at least 18 and attend college, high school, or a home-based private education program qualify for the $130 filing-fee waiver when every LLC member or organizer meets those requirements.
Argument forEligible high school and homeschooled students could avoid the $130 filing fee when every LLC member or organizer qualifies.
Argument againstA student startup with even one member or organizer who does not qualify may have to pay the filing fee, even if the other founders qualify.
More detail
The Department of Financial Institutions does not collect the $130 filing fee when all LLC members or organizers are student entrepreneurs. The waiver applies only when all members or organizers of the LLC are student entrepreneurs. A student entrepreneur must be at least 18 and enrolled in a Wisconsin postsecondary institution, a public, private, or tribal high school, or a home-based private educational program. The rule applies to articles of organization filed on or after the act’s effective date, the first day of the second month beginning after publication.
