Starting July 1, 2026, Wyoming licensees give buyers or sellers a written relationship disclosure before certain real estate discussions or agreements.
Before certain real estate discussions or written agreements, licensees give buyers or sellers a written statement of their relationship. Open house showings, preliminary conversations, and requests for factual information do not trigger it.
The written statement tells customers they can view or tour real estate without signing a written agency agreement, and that their communications with the licensee are not confidential.
A representation agreement is not valid until the buyer or seller acknowledges receiving the disclosure. If they refuse to sign, the licensee may document the refusal and continue services.
A licensee must give buyers or sellers a written statement of the applicable relationship before certain real estate discussions or written agreements. This applies to real estate licensees dealing with buyers or sellers. Open house showings, preliminary conversations, and requests for factual information do not trigger this disclosure. The disclosure must include the minimum information listed in the law. Agreements made before July 1, 2026, are not altered by this law. The law takes effect July 1, 2026. It does not alter agreements made before that date.
The written statement must tell customers they do not have to sign a written agency agreement to view or tour real estate, and that their communications with the licensee are not confidential. A customer includes a person interested in buying, selling, or leasing real estate, someone attending a showing without an agency relationship, or a transaction party without an agency or intermediary relationship with an involved licensee. These disclosure provisions take effect July 1, 2026.
A representation agreement is not valid until the buyer or seller acknowledges receiving the written disclosure; if they refuse to sign, the licensee may document the refusal and continue providing services. This applies to buyers and sellers receiving the written relationship disclosure. The disclosure and acknowledgment alone do not create a contract or agreement with the licensee. The licensee may document a refusal with the licensee's signed acknowledgment after presenting the disclosure. This requirement takes effect July 1, 2026.
No hearings or votes scheduled.
