State officials must tell people connected to residential habilitation centers and lawmakers about federal compliance findings, correction plans, and later updates.
When the department receives notice that a residential habilitation center fails federal requirements, state officials must share the findings, correction plan, and later compliance or enforcement updates with people connected to the center and lawmakers.
State officials must share information about a center’s federal compliance problems and later updates. These rules cover residential habilitation centers found out of compliance with federal Centers for Medicare and Medicaid Services conditions or requirements. The department’s duty applies after it receives notice that a center does not meet federal participation conditions or requirements. Notices must be shared with residents, visitors, people asking about placement, certain individuals connected to residents, and relevant legislative committees. Posted notices must be in English and any other languages residents have requested; notices to connected individuals must use their preferred language when they have indicated one. Committee notices must be sent within existing resources. Officials must provide notice within 10 days after the department receives notice of noncompliance. They must keep posted notices up until the federal agency is satisfied that the violation is corrected.
