Vermont law requires consent from both the patient and the health care provider before either makes or arranges a recording of their remote medical consultation.
Patients and health care providers cannot record, or arrange to record, a telemedicine or phone consultation unless both agree to the recording.
Patients and health care providers must both consent before either records or arranges a recording of their consultation. The rules cover telemedicine consultations and medical consultations by audio-only telephone in Vermont. Consent from only the patient or only the provider is not enough. The recording rules took effect on passage, April 20, 2026, when the Governor signed the law.
