1
What it does
A person who meets strict history and sentence-completion rules may ask once to expunge an eligible offense committed at least 10 years after a conviction under § 55-10-401.
Argument forPeople who meet the requirements could seek to clear an eligible record, which may improve future opportunities after a long waiting period.
Argument againstStrict payment, sentence-completion, prior-expungement, and conviction-history rules could prevent some people from using this petition process.
More detail
A person may file one petition to have an eligible offense expunged. The process covers an offense eligible under the cited law when it occurred at least 10 years after the person's conviction under § 55-10-401. The person must finish all parts of the sentence, including paying fines, restitution, court costs, and other assessments. The person must complete any imprisonment or probation and meet all supervised or unsupervised release conditions. The person must not have received an earlier expungement under the listed provisions. The person must not have more than one conviction under § 55-10-401. Other petition rules listed in the text would also apply. The subsection states that it is effective July 1, 2025. The act itself states that it takes effect upon becoming law.
