Beneficiaries of covered workers who die in the line of duty would receive a payment based on the date of death.
Beneficiaries of covered workers who die in the line of duty would receive $75,000 or $100,000, depending on when the death occurred. Certain other work-related or retirement-related deaths may qualify for a separate payment.
The listed employers or the state fund would pay beneficiaries of covered workers who die under the listed circumstances. For a line-of-duty death, the payment is $75,000 for deaths on or before December 31, 2005, and $100,000 for deaths on or after January 1, 2006. A separate payment covers certain other work-related or retirement-related deaths. Payments are subject to the cited code sections. The nonparticipating employer, contributing nonprofit college, or contributing private police department pays where specified; the state fund pays on behalf of participating employers. For the separate payment after certain work-related or retirement-related deaths, the worker's death must meet at least one listed condition: it arose from and occurred during employment, was within five years after retirement, or was caused by a listed cancer within the stated retirement period. The separate payment is $75,000 for a death on or after January 1, 2025, and $25,000 for an earlier death.
