A court would return a forfeited weapon if a qualifying person petitions and the court finds good cause. This applies to a weapon forfeited to the Commonwealth after its use in a criminal offense and its lawful owner. The owner must not have known, or had reason to know, about the conduct that led to forfeiture. The owner must be allowed by law to possess the weapon. The owner must file a sworn statement acknowledging that they took back the weapon. A court may return the weapon only after all relevant proceedings conclude.
