This proposal would let local stormwater authorities and some sewer operators enter property to investigate, and address required land work after an owner fails to act.
Local stormwater authorities and regulated sewer operators may enter property to gather information or investigate possible violations. Nonlocal operators may enter only property that sends a discharge into their system.
If an owner fails to take acceptable action after proper notice, a stormwater authority may enter property to start or continue actions required by its conditions for land-disturbing activity.
A locality serving as a stormwater authority or a regulated sewer system operator may enter property to gather information or investigate. This applies to localities serving as stormwater authorities, regulated municipal storm sewer operators, and their authorized agents. Entry must be at reasonable times and under reasonable circumstances, and must be needed to enforce the stormwater law. A regulated sewer operator that is not a locality may enter only property that sends a discharge into its system.
A stormwater authority may enter property to start or continue actions required by its conditions for land-disturbing activity. This applies when an owner fails to meet a stormwater authority's conditions for a land-disturbing activity. The owner must receive proper notice and fail to take acceptable action within the time specified. Entry may follow the owner's failure to act within the time specified after proper notice.
