Licensed shops may serve alcohol to patrons without grooming services
Alcohol service counts as an accessory use, so the business need not have a separate classification or physical separation if it meets other legal requirements.

What it does
The commission must limit fees to costs of carrying out this part, maintaining its technology and software, or other costs it considers necessary.
A licensed restricted retail business may serve alcohol to any lawful patron, even if the patron is not then receiving barbering or cosmetology services.
Argument forServing patrons who are not getting grooming services could make it easier for them to enjoy a drink during a visit.
Argument againstAllowing fees for other costs the commission considers necessary could leave businesses paying fees beyond program and technology costs.
More detail
The commission must limit fees to specified costs or other costs it considers necessary. This applies to fees the commission sets under this part of the alcoholic beverage law. The commission must set the fees through rules under state administrative procedures law.
A restricted retail business with the specified license may serve alcoholic beverages to any lawful patron. This applies to a restricted retail business licensed under section 57-4-102(34), including when the patron is not then receiving barbering or cosmetology services. Serving alcohol counts as an accessory use and, by itself, does not require a separate business classification, occupancy designation, or physical separation on the premises, if all other legal requirements are met. The act took effect on May 19, 2026.
