What it does
Sheriff's departments in federal 287(g) programs must follow federal immigration detainers, including holding a person for 48 hours beyond when they otherwise would be released. Saturdays, Sundays, and holidays do not count toward those 48 hours.
Argument forFederal immigration authorities may have more time to take custody of people held under detainers.
Argument againstPeople named in detainers could remain in a sheriff's custody for up to 48 hours beyond their otherwise scheduled release, excluding Saturdays, Sundays, and holidays.
More detail
Sheriff's departments covered by the law must accept and honor immigration detainers from federal authorities. This applies to sheriff's departments currently operating under an available federal 287(g) program. Departments must follow the conditions requested in the detainer, including keeping the person in custody for the stated period and notifying federal authorities as soon as possible before release. The law takes effect July 1, 2026. The 48-hour period begins when the person otherwise would have been released from the department's custody.
