What it does
A county or town may ask the state to study highway noise near homes if woods were cleared for reasons unrelated to highway work and no shielding remains. The local government must pay the study's actual cost before it begins.
Argument forA study could help a county or town assess highway noise near homes after woods are cleared and no shielding remains.
Argument againstLocal governments could spend money on the study before knowing whether it finds a noise problem that calls for further action.
More detail
A county or municipality may ask the state transportation department to study highway noise. The request may cover homes along the sound path of a state highway, including an interstate, if a tree zone was cleared for reasons unrelated to highway construction or physical changes to an existing highway, and no shielding or noise barrier remains. The department must approve the request and invoice the local government for the study's actual cost. The study cannot begin until the local government pays that cost. The law took effect on May 19, 2026.
