Utah counties and municipalities would follow rules for automatic annexations, advance notice, county accounting assignments, and annexation plats beginning May 6, 2026.
Certain small or surrounded unincorporated islands would join nearby municipalities on July 1, 2027, with limited options to exempt them.
Property owners in affected second-class counties would receive a map, date, and service information before their island is automatically annexed.
County councils may assign accounting work under specified safeguards, while annexation plats may show areas that are not connected to each other.
Certain unincorporated islands would automatically become part of a nearby municipality. The rule covers islands in first-class counties and islands of 55 acres or less in second-class counties that meet the listed surrounding-boundary and service or infrastructure conditions. In a first-class county, the island generally goes to the most populous bordering municipality, unless two municipalities agree by resolution on another bordering municipality. In a second-class county, the island goes to the municipality that completely surrounds it. A second-class county with fewer than 600,000 people may exempt an island by resolution. In a second-class county with at least 600,000 people, the municipality may exempt an island by resolution. The automatic annexations occur on July 1, 2027. Required county or municipal exemptions must be adopted by May 1, 2027, and the annexation's effective date is otherwise governed by the filing rules in Section 10-2-813.
A second-class county would notify property owners before an automatic annexation. The notice applies to each owner of real property in a second-class county island that will be automatically annexed. The county must mail a written notice with the island's description and map, the effective date, and information about the receiving municipality's services and contact details. The county must also publish the notice on the Utah Public Notice Website and consult the municipality when preparing it. The county must provide the notice no later than May 1, 2027, before the automatic annexation scheduled for July 1, 2027.
Some county councils may delegate countywide accounting services, and a final annexation plat may show noncontiguous areas. Accounting delegation applies to counties using the executive-council or council-manager form of government, subject to the listed audit and ordinance requirements. Plat changes apply to proposed annexations. Executive-council counties may delegate accounting services to the county executive or a county office or department leader by ordinance. Council-manager counties may delegate them to the county manager or a county office or department leader if the county auditor reviews all payments and the ordinance meets the stated deadline. Delegations must protect county assets and include appropriate checks and balances. A final plat must still meet survey, approval, and recording requirements. The plat provision applies when a final local entity plat depicts a proposed annexation. The council-manager delegation provision refers to an ordinance passed on or before December 31, 2021.
