Parole board may review some minors’ secure care placement
Starting May 6, 2026, the parole board may review some minors’ placements after a prosecutor asks, and must appoint counsel for the minor.

What it does
After a prosecutor asks for review, the parole board may move some minors convicted of aggravated murder from secure care to an adult prison. The board must appoint counsel for the minor.
State agencies track juvenile cases and follow-up outcomes, including when minors enter diversion or receive a court disposition. The commission reports the data and may recommend legislative action.
Argument forA board review could address concerns about a minor’s placement, while appointed counsel gives the minor help during the review.
Argument againstA minor could be transferred from secure care to an adult prison after a board review, changing where they serve their sentence.
More detail
After a prosecutor files a motion, the Board of Pardons and Parole may review the minor’s placement and may order a transfer to an adult prison. This applies to a minor serving a prison commitment who is provisionally housed in a secure care facility, was 17 when the aggravated murder occurred, and is at least 18 at sentencing. The board must appoint counsel for the minor for the motion. A transfer may be ordered only if the minor meets the stated conviction and age requirements and the board finds the transfer warranted. This provision takes effect May 6, 2026. The text sets no separate deadline for filing or deciding the motion.
State agencies collect and report information about juvenile justice cases, including juvenile recidivism. The provisions cover minors who enter diversion or receive juvenile court dispositions. Juvenile recidivism includes diversion, a court finding, or conviction within specified follow-up periods after a nonjudicial adjustment or a juvenile court disposition. The commission’s report includes collected data and recommendations for legislative action. The Administrative Office of the Courts submits data before July 1 each year. The commission submits its report on or before October 1.
