The South Dakota Board of Technical Education must publish an annual report about covered foreign-source funding given directly to the board or a school it oversees. The report covers funding from a foreign source given directly to the board or a school under its control. For each instance, the report must give the amount and source, describe the type and purpose, say whether it is part of an ongoing relationship, identify the source including its name and address when applicable, and include an associated document. Information that state or federal law deems confidential need not be disclosed. For this reporting rule, a foreign source is a foreign government, person, or organization from China, Cuba, Iran, North Korea, Russia, or Venezuela. An organization may qualify because it is registered outside the United States or has foreign ownership, as specified in the law. Tuition and related fees paid to support a student enrolled at a technical school are excluded from funding. The rule applies to funding received on or after July 1, 2026. Each report covers funding received from July 1 through June 30 and must be published by August 31.
