South Dakota’s signed law requires the agency handling crime victims’ compensation claims to explain its decisions and tell claimants they may request commission review.
The law requires written decisions on properly filed crime victims’ compensation claims. Claimants receive the decision and notice that they may ask the commission to review it.
The law also directs the removal of section 23A-28B-31 from state law. Its effect on people seeking crime victims’ compensation is unclear because that section’s contents are not included.
The agency handling crime victims’ compensation must review and investigate properly filed claims and issue written decisions. These requirements cover properly filed claims through South Dakota’s crime victims’ compensation program. A decision may award no payment. Each decision must state the facts, any payment amount, who receives payment, and the claimant’s option to request commission review. The agency must file the decision with the commission and send the claimant a copy by mail, email, or hand delivery.
Section 2 directs the removal of section 23A-28B-31 from state law.
