Courts would delay an eviction order day by day during listed dangerous weather for tenants in certain public benefit programs. Afterward, the eviction would get priority and must be carried out within five days.
A local judge would pause an eviction order day by day during qualifying extreme weather. This would cover tenants in one of seven listed public benefit programs when the eviction order is served. Qualifying weather means 32°F or lower, including the next-day forecast, or listed National Weather Service warnings for severe winter weather, tropical storms, hurricanes, or excessive heat. After the weather ends, the eviction would get priority and must be carried out within five days. The provision would start 60 days after enactment.
