A municipality may approve an ordinance to remove illegal discriminatory wording from a recorded plat, and the county clerk must redact it from the online plat after receiving an affidavit. This applies to existing recorded plats with illegal discriminatory restrictions under the federal Fair Housing Act. The municipality must give every property owner in the addition 30 days’ written notice of the proposed amendment and the planning commission meeting. The municipality’s governing body must approve the amended plat; property owners do not all have to approve it. The municipality must submit an affidavit identifying the plat and the wording to remove, with a copy of the plat showing that wording. The law takes effect November 1, 2026. The clerk must make the online redactions upon receiving the municipality’s affidavit.
