If enacted, Oregon’s health authority could not analyze why providers or payers exceeded the state cost growth target or penalize them before 2036.
For providers and payers that exceed Oregon’s health care cost growth target during 2021–2035, the state health authority could not analyze the cause, require an improvement plan, or impose a financial penalty before 2036.
The Oregon Health Authority would be barred from analyzing why some providers or payers exceeded the health care cost growth target. It applies to providers and payers that exceed the target during calendar years 2021 through 2035. The bar also prevents the authority from requiring a performance improvement plan or imposing a financial penalty. If enacted, the measure would take effect 91 days after the 2026 regular session adjourns. The bar applies before January 1, 2036, and this section would be repealed on January 2, 2036.
