Starting January 1, 2027, Oregon rental agreements must disclose where smoking is allowed, and some landlords may later ban indoor smoking under specific conditions.
For some shared-wall or development-agreement homes, landlords may ban smoking inside homes and indoor shared areas without tenant consent, if they provide a posted smoking area and give advance notice.
Rental agreements must say whether smoking is allowed on the property and name the places where it is allowed if permission is limited to certain areas.
A landlord may change a smoking policy to ban smoking inside homes or indoor shared areas without each tenant’s written consent. This applies when a landlord changes a smoking policy for a covered rental home. Smoking means inhaling or possessing a lit tobacco product. The home must be in a building developed under a development agreement or share a wall with another home, and it cannot be an accessible unit. The landlord must provide and post an area on the property where smoking is allowed, and give written notice at least 180 days before the change. The change cannot apply to a fixed-term rental until that rental term ends.
A rental agreement must disclose whether smoking is banned, allowed throughout the property, or allowed only in named areas. This applies to rental agreements for homes governed by Oregon’s residential landlord-tenant law. The rule does not apply to agreements for space in a facility covered by ORS 90.505 to 90.850. This applies to rental agreements made before, on, or after January 1, 2027.
