For criminal cases filed on or after its effective date, Oregon law sets different arraignment deadlines for people in custody and other people who are arrested.
People held in custody must be arraigned within the first 36 hours, unless there is good cause or they ask for more time. Other cases have a 96-hour limit, with certain court closing times excluded.
Oregon law sets deadlines for arraignments after a charging document is filed and a person is arrested. These deadlines apply to arraignments on charging documents filed on or after the law’s effective date. For a person in custody, arraignment must happen within the first 36 hours of custody unless there is good cause or the person asks for it to happen later. In other cases, arraignment must happen within 96 hours after arrest, except as provided by ORS 133.060. The deadlines apply to charging documents filed on or after the law’s effective date. The 36-hour limit excludes holidays and weekends; the 96-hour limit also excludes time when the court is closed during normal business hours.
