Contractors on certain approved gas pipeline and power plant projects must follow public construction wage rules, except for older contracts and some electric utility contracts with labor or worksite agreements.
Contractors must follow public construction pay rules on certain approved utility projects that do not count as public construction. This covers contracts entered into on or after October 1, 2025, with exceptions for electric utility contractors with specified labor or worksite agreements.
Contractors and subcontractors must follow the wage rules used for public construction on covered utility work that does not count as public construction. Covered projects are gas pipeline replacements and new electric generating facilities of at least 50 megawatts, each approved in the required utility plan. Covered utilities purchase natural gas for retail sale or are electric utilities. Electric utility contracts are exempt when the contractor doing the main construction has a collective bargaining agreement with workers, a project labor agreement, or a qualifying worksite agreement. A qualifying worksite agreement must cover construction of the project or maintenance or other ongoing work after completion. The requirement does not apply to contracts entered into before October 1, 2025.
