The Division of Child and Family Services does not have to deduct publicly funded care costs from children’s state trust accounts. These accounts hold survivor benefits and other awards for children receiving child welfare services in counties with fewer than 100,000 people. The balance goes to the parent or legal guardian, or directly to a child who is at least 18 or legally independent through emancipation. The law took effect July 1, 2025. The agency must return the balance when it is no longer legally responsible for the child.
