The State Treasurer would deposit New Jersey’s share of settlement money into a dedicated fund. The fund would receive New Jersey’s share of money from the August 2026 settlement, including settlement money received by state departments. Deposits would follow the settlement agreement’s terms. The fund could also receive interest, other income, and other money made available for its purposes. The fund could pay attorneys’ fees, costs, and litigation expenses related to the settlement. If enacted, the act would take effect immediately and apply retroactively to August 25, 2026.
The Department of Human Services would direct and monitor how settlement money is spent on youth mental health and related online harms. Uses could include youth mental health programs and treatment, online safety and anti-bullying education, peer and family support, research, and related administration. Money for these purposes, other than settlement-related legal fees and costs, would have to follow the settlement agreement and support evidence-based or evidence-informed approaches. Human Services would emphasize approaches supported by evidence and consider access for underserved communities. Transfers to other state departments would need approval from the budget office.
