Certain retail liquor stores would not have to follow the electronic-transfer or credit-card payment rules for liquor deliveries. This covers stores operated by, or located with, a person holding a nonrestricted gaming license or an affiliate. It also covers certain restricted-license holders who also hold a nonrestricted license or are affiliates of such a holder. The exception applies to the payment rules in subsections 5 and 6. The text does not state what payment method these stores must use instead. The provision would apply when the act becomes effective upon passage and approval.
Wholesale dealers would charge a delinquent retail liquor store a service fee of 1.5 percent of its unpaid balance. The fee applies to a retail liquor store that has not paid for delivered liquor under the payment rules in this section. The wholesale dealer must charge the fee on the 15th day of the month after delivery and each month afterward while the balance remains unpaid. The charge begins on the 15th day of the month following delivery and repeats on the 15th day of each later month.
