New Jersey electricity providers serving only new business and other nonresidential demand would operate outside general utility oversight while disconnected from the state grid.
Providers serving only new electricity demand outside homes would operate outside general utility oversight while off-grid. Environmental and safety rules would still apply, and grid connection would trigger oversight.
Eligible off-grid electricity providers would operate outside general oversight by the New Jersey Board of Public Utilities. The provisions cover New Jersey providers serving only new industrial, commercial, and other nonresidential electricity demand through facilities disconnected from the state grid. Providers would still follow environmental permit requirements, building and fire codes, and workplace safety rules. Facilities in existing public rights-of-way would also follow applicable permit, restoration, public safety, and maintenance requirements. Connecting to the state grid would bring a provider under general utility oversight, though it could keep generating electricity. These provisions would take effect immediately if the bill becomes law.
