LB 1042 was indefinitely postponed; its proposed text would generally bar combining household members' coverage limits while allowing unrelated policyholders to combine theirs.
The proposed text would generally keep people from combining coverage limits from policies held by them or related household members. It would allow limits from separate policies held by unrelated people to be combined for one accident.
When several policies may cover an injury, the proposed text would rank them: coverage for the vehicle the person occupied, then a vehicle that injured them as a pedestrian, then another vehicle under their policy.
The proposed text would allow some uninsured or underinsured motorist coverage limits to be combined for one accident. Limits under policies held by the same person or related people living in one household generally could not be combined, except as provided in section 44-6411. Limits under separate policies held by different policyholders who are not related household members could be combined. The permission applies regardless of the wording in the insurance policies.
The proposed text would set an order for which insurance policies pay when more than one may cover an injury. For multiple policies, the listed order is coverage for the vehicle the injured person occupied, then a vehicle that injured the person while they were a pedestrian, then a vehicle not involved in the accident under which the person is insured. For an injury while riding in a vehicle the insured does not own, that vehicle's coverage would pay first. Other available coverage would pay after it is used up, subject to the limit for policies held by the same person or related household members.
