Nebraska’s proposal would include certain non-sworn courthouse workers in assault rules for public safety officers when they are carrying out official duties.
The proposal includes certain courthouse workers in assault rules for public safety officers. The offense level depends on the injury and, for some offenses, whether a dangerous instrument was used.
The proposed text includes court operations officers in the definition of public safety officers covered by assault offenses. A court operations officer is a non-sworn county, court, or judicial-district employee whose main job involves public contact to screen visitors, serve court papers or orders, or keep court facilities or proceedings safe. For these assault offenses, the public safety officer must be carrying out official duties when the injury occurs. The bill was introduced and later indefinitely postponed, so this proposal is not shown as law.
