If enacted, Nebraska electric suppliers serving customers who are waiting for service would need an allowed reason and a formal resolution before closing or substantially changing covered facilities.
Electric suppliers with customers waiting for service would have to keep covered generation facilities operating unless a listed exception applies, and their governing body first adopts a supporting resolution.
An electric supplier would not be allowed to retire, shut down, stop operating, or substantially change an electric generation facility. The rule would cover electric generation facilities and privately developed renewable energy facilities when the supplier has customers waiting for electric service. The restriction would not apply when federal or state law requires the action, the facility is mechanically unsafe, a natural disaster damaged it beyond repair, or continued operation is uneconomical. Before taking the action, the supplier's governing body would have to adopt a resolution identifying at least one allowed reason. The resolution would have to be adopted before the retirement, shutdown, cessation, or substantial operating change occurs.
