The postponed proposal would require Nebraska child welfare officials to tell suggested nonrelatives with prior ties to a child about removal and care options.
Nebraska child welfare officials would notify suggested nonrelatives who meet the bill’s relationship rules within 30 days of a child’s removal. They would also report their contacts and responses to the court.
Nebraska’s Department of Health and Human Services would find suggested nonrelatives, notify them about care options, and report contacts and responses to the court. This covers children removed from home or voluntarily placed in care. These nonrelatives must have previously lived with the child or be trusted adults with an existing, significant relationship. The bill calls them “fictive kin.” The child, the child’s parents, or relatives must suggest these adults. Notices would explain care options, caregiver requirements, available support, and the option to apply for payments to help with guardianship. Rules under the Nebraska Indian Child Welfare Act may govern the initial duties following removal. Written notices would be due within 30 days after removal. The court report would be due within 30 calendar days after removal.
