The measure would allow certain all-terrain and utility-type vehicles to operate at night and cross some wider highways if local approvals and safety rules are met.
Operators could drive all-terrain and utility-type vehicles at night in approved local areas, including for snow removal, if they meet lighting, insurance, licensing, speed, and safety rules.
Approved utility-type vehicles could cross wider controlled-access highways at signal- or stop-sign-controlled intersections; agricultural vehicles could cross under the listed operating rules.
All-terrain and utility-type vehicle operators would be allowed to drive between sunset and sunrise in certain local areas. The rule would cover operation within a city, village, or unincorporated village when local approval allows it, including snow removal. The vehicle would need required white headlights and a red taillight visible from 500 feet. Operators would need a valid Class O license or farm permit, liability insurance, and a speed of 30 miles per hour or less. Operators would need to show proof of insurance within five days after a peace officer requests it. The vehicle's headlights and taillights would need to be on, and it would need a required safety flag. The nighttime rules would apply during the hours between sunset and sunrise if the other listed requirements are met.
Utility-type vehicle operators would be allowed to cross certain controlled-access highways at approved intersections. The rule would cover controlled-access highways with more than two marked lanes and would include utility-type vehicles at signal- or stop-sign-controlled intersections. The crossing would have to follow the traffic signal or stop signs. A city or village ordinance or a county board resolution would have to specifically approve the crossing, depending on the location. Agricultural use would also allow the crossing when the vehicle follows the operating requirements in subsection (3). The vehicle could not use a controlled-access highway for travel, and the crossing would remain subject to the listed operating requirements. The crossing rules would apply when the required local approval exists and the operator follows the applicable operating requirements.
