The bill would set rules for Haywood County vacancies, partisan Jackson County school board elections, and Jacksonville’s planning authority outside city limits.
Haywood County would use the bill’s referenced rules when filling vacancies on its county board, starting with vacancies filled after the bill becomes law.
Jackson County school board elections would use partisan ballots, while 2024 members keep their terms; the 2026 election would follow these rules before they formally take effect.
Jacksonville would not use its state-granted planning powers outside its connected city limits, although existing development rules and enforcement would continue for a stated period.
The bill would apply the referenced county-commissioner vacancy rules to Haywood County. This provision applies only to vacancies on the Haywood County Board of Commissioners. It would take effect when the bill becomes law and apply to vacancies filled on or after that date.
Jackson County would hold school board elections on a partisan basis. The rule covers five board members elected from five single-member residency districts, with each member elected by voters across Jackson County; candidates must live in the district they seek to represent. Candidates must be qualified voters and residents of their residency districts. The 2024 members’ terms would not be changed. Vacancies in seats held by those members would be filled by the remaining board members for the rest of the term. The provision would take effect on the first Monday in December 2026, and the 2026 elections would be conducted as if it were already in effect.
Jacksonville would stop exercising its Chapter 160D planning and development powers beyond its contiguous city limits. The limit applies to areas outside Jacksonville’s contiguous corporate boundaries. Jacksonville’s development rules and enforcement powers would remain in effect outside the city until the time specified by G.S. 160D-202(h). The relinquishment would begin when this section becomes law, subject to the continued use of existing regulations and enforcement until the statutory time.
